POLICY
This
policy covers how Ripple100, LLC (“Ripple100” or “we,”) treats personal
information that it collects and receives on www.ripple100.com. We use information shared with us for the
sole purpose of running and improving our services. This notice tells you what information we
collect, steps we take to protect and secure it, how we use and share
information, and finally, how you can contact us with questions or concerns. We use terms in this Policy that are defined
in our Terms of Service and not separately defined here. For your convenience, we have hyperlinked
those terms to our Terms of Service.
1. Information We Collect.
We collect personal information when you register with us, Upload information or Content
to our website or otherwise use our Services. We refer collectively to all the information
we collect as “User Information.”
(a) Registration. When you
register with us, we collect your name, email address, user name and your
password (“Registration Information”).
Your password is stored securely using an enhanced one-way hash
technology.
(b) Content. We collect Content
that you Upload to our website.
(c) Billing. We collect billing
information if you are a Publisher or otherwise
sign up for a paid service, which may include your name, address, telephone
number, credit card details, and other information that is necessary in order
to process the transaction (“Billing Information”). Sufficient billing information is maintained
to permit us to process subscriptions and other recurring fees. Billing information is encrypted and stored
on a secure server. We use a third party
to process and handle transactions involving credit cards. We never store credit card information or
billing information (only a transaction ID). Should you terminate
the Service, your billing information will be promptly deleted following
payment of all amounts due.
(d) IP Information. We may
automatically or otherwise receive and record information on our server logs
from your browser, including your IP address, cookies, and the pages you
request, or collect other use information as part of our analytics services
(“Technical Information”).
(e) Promotion Information. From
time to time, we may seek information in a form, survey, or forum, or may
sponsor a promotion, sweepstake or contest on the Service (“Promotional
Information”). You may be asked to provide personal information including but not limited to name, email address or home
address or to answer questions in order to participate. Promotional Information we solicit which
require sensitive information such as financial information to process are
treated as Billing Information.
We refer to all User Information other than Content as “Personal
Information.”
2. How We Use User Information.
We use the User Information we collect for the following purposes.
(a) Registration Information. We
use your Registration Information to identify and validated your use of the
Services and to identify the particular Services you are entitled to use. We may also use the information to contact
you concerning products and services provision, services improvement, support
and research.
(b) Billing Information. We use
Billing Information to obtain payment for the Services for which we
charge.
(c) Content. We maintain your Content in accordance with the Terms of Service to maintain the Service. Your Content will generally be available on the Service to all Users, and, accordingly, should not be considered personal, sensitive, confidential, proprietary or non-public information.
(d) IP Information. We may
automatically or otherwise receive and record information on our server logs
from your browser, including your IP address, cookies, and the pages you
request or other session information, or collect other use information (i) as
part of our analytics services, (ii) in order to improve the Service, (iii) to
diagnose and prevent service or technology problems reported by our Users or
our staff; (iv) to compile statistics concerning hits to Ripples and other usage data, which data and
statistics we may publish.
(e) Promotional Information.
Promotional Information will be used only to notify you and arrange
delivery of promotional items to you, to improve the Services or otherwise as
we use IP Information.
(f) User Information Generally. We may use any User Information we
collect at any time to determine which Users have access privileges to certain
Services, to monitor and prevent fraud and abuse, to enforce our Terms of
Service, to assure our compliance with law and your compliance with law in
using the Service, and to bill and collect fees and other amounts owed to
us.
3. Security of
Collected Information.
Personal Information is not available to Users of the Service and is
segregated from Content. Registration
Information and Billing Information are not linked to each other or to any
other personally identifiable information, and are maintained on secure servers
and are SSL encrypted. Billing
Information is deleted following termination of the Service and payment of all
amounts due. IP Information that does
not contain personally identifying information or sensitive information about
you will still be segregated from Content, but may be compiled on servers that
may not be secure and may not be encrypted.
Aggregated data compiled from the IP Information of unidentifiable
groups of Users may be posted by us on the Service. IP addresses of Users voting or commenting on
a Ripple may be retained for our internal use to prevent individuals from voting
multiple times.
4. Information Use, Sharing and
Disclosure. We do not share Personal Information
we learn about you from your use of the Services with others except as
described in this policy. We do not
share, sell, rent or trade Personal Information with third parties for their
promotional purposes.
We may use your Content on our Service in accordance with the Terms of
Service, but, other than as expressly described in this Policy, will not share
or disclose your Content in any manner that is inconsistent with your license of the Content to us under the Terms of Service.
We may use or share your personal information
where it is necessary to complete a transaction, to operate or improve the
Services, or to do something that you have asked us to do. We may use third parties such as a credit card
processing companies to bill you for goods and services. In this case, we may share Billing
Information with such third parties as is necessary to complete billing and
collection for the Services. Although we
are not responsible for the safety and security of your Billing Information
shared with third party billing or credit card processing, we will use
reasonable efforts to deal only with third parties we believe to be reputable
and reasonably secure and will disclose only such Billing Information as we
believe reasonably necessary to complete the billing. These third parties are prohibited from using
your personally identifiable information for promotional purposes.
Aggregated data compiled from the IP Information of unidentifiable
groups of Users may be posted by us on the Service.
We may share Personally Information about you or Content under the
following circumstances: (a) to respond
to subpoenas, court orders, or legal process; (b) to establish or exercise our
legal rights or, defend against legal claims and if in our judgment in such
circumstances disclosure is required or appropriate; (c) to investigate,
prevent, or take action regarding illegal activities, suspected fraud,
situations involving potential threats to the physical safety of any person,
violations of our Terms of Service; (d) as
otherwise required by law; (e) to protect our infrastructure and the security
and integrity of our Services; and (f) in connection with any violation or
alleged violation by you of the Terms of Serviceor failure or alleged failure to pay any amount you owe us.
As we continue to develop our business, we may also buy or sell all or
part of our business. In such
transactions, Personally Information you have shared with us is generally one
of the business assets that will be transferred. However, the transferred Personally
information will remain subject to this privacy policy or subsequent policies
to which you have consented.
5. Content Not Private.
Your Content will be available on the Service to all Users. Text, graphics, sounds, videos and
objects you Upload can be freely viewed by Users. HTML, XTML, JavaScript and other code used in
your content may be viewable in some web browsers, and the code attendant to other
software or applications forming a part of your Content may be capable of being
viewed, reverse engineered or debugged by Users. Accordingly, you should not include personal,
sensitive, confidential, proprietary or other non-public information in your
Content. We are not responsible for the
safety, security, privacy or confidentiality of your Content. If you post personal information online that is
accessible to the public, you also may receive unsolicited messages from other
parties in return.
6. Cookies. A cookie is a computer file
containing data, which often includes a unique identifier that is sent to your
browser from a web site's computers and stored on your computer. We may use our own cookies for a number of
purposes, including to (a) terminate your session after a certain period of
time has elapsed to protect you against others accessing your account; (b) keep
track of preferences you specify while you are using the Services; (c) conduct
research to improve our Services; and (d).keep statistics on the audience
sizes, traffic and other technical information about our Ripples.
Most web browsers allow you to configure them to
accept all cookies, reject all cookies or notify you when a cookie is set. If you reject all cookies, you may not be
able to use our Services or to take full advantage of the Services.
Ripple 100 will generally use a session cookie that
stores a randomly-generated identification string for use in login areas of the
website. Session cookies will be
destroyed at user logout, after long periods of inactivity or when the browser
is closed.
7. Information Relating to Children. Users under the age of 13 are prohibited from
using Ripple100. If we become aware that
a user under the age of 13 years of age has registered on this site, we will
take appropriate steps to assure that all personal information related to that
child is deleted from the Service. If
you are the parent of a child under the age of 13 who has registered on the
Service, please contact us to have your child’s registration terminated and
personal information deleted.
8. Opt-Out. You may opt out of emails you receive from us
for promotions, sweepstakes or contests, please email us at info@ripple100.com.
9. Protecting Your Own Security. No data transmissions over the Internet can
be guaranteed to be 100% secure.
Consequently, we cannot ensure or warrant the security of any
information – whether Personal Information or Content –you transmit to us and
you do so at your own risk. Once we
receive your transmission, we make reasonable commercial efforts to ensure
security on our systems. We use
physical, electronic, and procedural safeguards to protect personal information
about you. Your account information is
password-protected.
Although we use industry-standard SSL-encryption to protect certain
data (especially Registration Information and Billing Information), we cannot
guarantee that such information may not be accessed, disclosed, altered or
destroyed by breach of firewalls and secure server software.
If we learn of a security systems breach we may attempt to notify you
electronically so that you can take appropriate protective steps. By using our Services or providing Personal
Information to us you agree that we can communicate with you electronically
regarding security, privacy and administrative issues relating to your use of
the Services. We may post a notice on
our applicable web sites if a security breach occurs. We may also send an email to you at the email
address you have provided to us.
10. Third
Parties. We under
certain circumstances may allow other companies to serve
advertisements within the Services.
These third-party advertisers or ad servers may use technology to send,
directly to your browser, the advertisements that appear on the Services and
they may automatically receive your IP Address and other log file information
when this happens. Such third parties
may also use other technologies to measure the effectiveness of their
advertisements and to personalize their advertising content. We do not otherwise provide your Personal
Information to these third parties. You
should consult the respective privacy policies of these third-party advertisers
or ad servers. This Policy does not
apply to, and we cannot control the activities of, such other advertisers or
web sites.
The Service, and Content provided by you or other Users, may contain
links to websites and services provided by third parties. Any Personal Information you provide on third
party sites or services is provided directly to that third party and is subject
to that third party's policies governing privacy and security. We are not responsible for the content or
privacy and security practices and policies of third-party sites or services to
which links are displayed on the Services.
We encourage you to learn about third parties' privacy and security
policies before providing them with Personal Information.
11. Changing your Preferences and Personal
Information. You can
edit your registration information with us at any time. You can delete your applicable registration
by visiting the applicable registration deletion page; however, please note
that some personal information, primarily your contact information, may remain
in our records to the extent necessary to protect our legal interests or
document compliance with regulatory requirements. If your Personal Information changes, or if
you no longer desire our service, you may correct, update, or delete such
information by making the change on our user home page.
12. Changes to this Privacy Policy. We may revise, modify or update this Policy
at any time. We will notify you about
significant changes in the way we treat personal information by placing a
prominent notice on our site.
